The Philippine Association of the Record Industry (“PARI”) is a non-stock, non-profit organization, organized in 1972 whose members are record labels and record production outfits. One of PARI’s objectives is to protect its members’ copyright against the unauthorized use, reproduction and sale of music and sound recordings in all mediums. This is in accordance to its members’ rights granted by the Intellectual Property Code of the Philippines (Republic Act No. 8293) and protected also under the Electronic Commerce Act of 2000 (E-Commerce Law).
The E-Commerce Law penalizes the unauthorized storage, uploading, downloading, communication, making available to the public, or broadcasting of protected material or copyrighted works including legally protected sound recordings or phonograms, in a manner that infringes intellectual property rights. A violation of this shall be punished by a minimum fine of One Hundred Thousand Pesos (P100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years.
You are infringing on copyrights owned by members of PARI by illegally distributing songs and music videos through giving out of illegal download links. These files are made available to your users without permission is a violation of the Intellectual Property Code of the Philippines.
This letter is to notify you of the aforementioned possible infringement and to formally demand your company to refrain from illegally distributing the said files. We request that you cease any further illegal distribution of infringing material through your company upon receiving this notice. PARI shall not commence any action against you should you act with deliberate speed to act on the matter.
PARI is providing you with this notice in good faith and with the reasonable belief that rights owned by members of PARI could be infringed. PARI is duly authorized by its members to prosecute and act on their behalf in matters concerning their copyrights. We hope that this matter receives preferential attention.
